The domain name BuynServ.com (hereinafter referred to as "Website") is registered in the name of Universal Trading Co; a company incorporated under the Companies Act, 1956 with its registered office at A-220, Morya House, Off New Link Road, Oshiwara, Andheri West, Mumbai - 400053, Maharashtra, INDIA (hereinafter referred to as “BuynServ.com”).

Your use of the Website and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Website. Membership Eligibility

Use of the BuynServ.com is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the BuynServ.com. (l) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

(n) contains video, photographs, or images of another person (with a minor or an adult).

(o) tries to gain unauthorized access or exceeds the scope of authorized access to the Website or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

(aa) shall not be false, inaccurate or misleading;

(ab) shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.

(ac) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;

On clothing, we accept returns subject to the following conditions:

Clothes are not used, worn (other than trials), stained; or damaged and are unwashed.

Original tags and packaging should be intact. For items that come in branded packaging, the box should be undamaged.

Original invoice is packed along with the returned products.

All accessories that come along with the products are packed and returned unaltered.

Note:

Replacement can be for the entire product or part(s) of the product subject to availability of the same on BuynServ.com.

30 Day Exchange Policy

Clothing sold on BuynServ.com is covered by our 30 Day Exchange Policy.

If you are not satisfied with the fit of the product, we will gladly exchange it with the size (or colour) of your choice. Exchange is subject to availability of the product on BuynServ.com. Alternatively, we can offer you a BuynServ.com Wallet Credit which you can use to place a fresh order.

In order to get the item exchanged:

- Contact Customer Care, within 30 days from the date of delivery

- The returned item will be recalled and an exchanged item will be shipped immediately

Exchange subject to the following conditions:

- Clothes are not used, worn (other than trials), stained; or damaged and are unwashed

- Original tags and packaging should be intact. For items that come in branded packaging, the box should be undamaged

- Original invoice is packed along with the returned products

- All accessories that come along with the products are packed and returned unaltered

- Innerwear, lingerie, socks and clothing freebies are not eligible for the 30 Day Exchange Policy

- Sunglasses and Jewellery (only Rings and Bangles), exchange can be requested for size mismatch

Order Cancellation

We reserve the right to cancel any order at our sole discretion, under a situation where we are not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the our policy or for any other reason. Arbitration

If any dispute arises between you and BuynServ.com during your use of the Website or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of the User Agreement, or the documents they incorporates by reference, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by BuynServ.com. The place of arbitration shall be New Delhi The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

Governing Law

The User Agreement or the documents they incorporates by reference shall be governed and construed in accordance with the laws of India.

This document is an electronic record in terms of Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
